Judge allows federal challenge to Prop. 8 to continue

After nearly two hours of legal arguments, a federal judge in San Francisco refused Wednesday to dismiss a lawsuit challenging California's Proposition 8  and ordered a trial on whether the measure denies fundamental rights to gays and lesbians.

US District Judge Vaughn R. Walker rejected contentions by Proposition 8's proponents that precedent and tradition showed last November's ballot measure permissible under the US Constitution, San Francisco Chronicle reports. His ruling paves the way for a scheduled January trial on the federal case challenging the constitutionality of the amendment that was added to the state constitution by the ballot measure.
